1. INTRODUCTION AND SCOPE.

1.1. Introduction. VIAT SERVICES LLC and our affiliated companies (collectively, "we") want you to be familiar with how we collect, use, and disclose information from and about you because we understand you are concerned about your privacy, and we want to maintain your trust.

1.2. Scope. This Privacy Policy (the "Policy") describes how we collect, use, and disclose information that we obtain about users of our website located at www.viatservices.com (the “Website”), applications, and software and the various product/services provided on or in connection with the Website (the "Product/Services"). The Policy also does not apply to any other website or online service operated by our company, or to any of our offline activities. It does not apply to any third party site or service linked to our Website or recommended or referred by our Website or by our staff. We are not responsible for the information practices of any third party Websites.

2. CONSENT TO USE OF PERSONAL INFORMATION.

2.1. Consent. By visiting the Website or by using any of our Product/Services (which includes taking any of our assessments) you are accepting the terms of this Privacy Policy and consenting to our collection, use, disclosure, retention, and protection of your personal information as described in this Policy. Your use of the Website and Product/Services is subject to this Policy and, if you are a Customer/Employer/User ("Customer") as defined by the Terms and Conditions of Sale and Use located at https://www.viatservices.com/termsandconditions ("Customer ToU"), or if you are an Assessment Taker as defined by the Assessment Taker Terms of Service located at https://www.viatservices.com/assessment-taker-terms-and-privacy ("Assessment Taker ToU"), and any other applicable terms that are required as a condition of your use of the Product/Services. You acknowledge that this Policy is part of your Customer ToU or your Assessment Taker ToU, as applicable. If you do not agree to these terms, please do not access or use the Website or Product/Services. Capitalized terms that are not defined in this Policy have the meaning set forth in your Customer ToU or your Assessment Taker ToU, as applicable, or in any other contractual document between you and VIAT Services.



3. INDIVIDUALS UNDER 18.

3.1. Individuals Under 18. We do not knowingly solicit or collect information from anyone under the age of 18 or allow people under the age of 18 to register for the Website. The Website and its content are not directed at individuals under the age of 18. If we learn that we have collected personal information from an individual under age 18 without parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 18, please contact us.



4. INFORMATION WE COLLECT.

4.1. Information We Collect. We may collect information that identifies you ("Personally Identifiable Information" or “PPI”) when you use our Website. We may collect information about you directly from you and from third parties or automatically through your use of our Website or Product/Services. The types of information that we collect may include any of the following:

(a) your name, address, phone number, birth date, billing and delivery information, email address, credit card, other financial account information, and any other nonpublic information about you that is associated or linked to any PPI. The specific PII we collect depends on how you are using the Services.
(b) If you are an ASSESSMENT TAKER or USER, we may obtain your User Data (as defined in the Assessment Taker ToU), including PII contained therein, from a Customer or another authorized third party. When you register to take a test or to otherwise use the Product/Services, you will provide us with your name and email address and demographic data, including your age, sex, gender, education level, profession, job role, and primary language ("Demographic Data"), however, will we not disclose to a Customer whether you've provided such Data or disclose any such Demographic Data to a Customer, except in an aggregate and anonymous form.
(c) If you are using the assessments for research purposes, we may obtain PII including information in section 4a and information regarding your position and qualifications including your institutional mailing address, email address, phone number, your educational qualifications, and your qualifications to administer psychological assessments.
(d) other information that you provide to us but that does not identify you personally, such as records of your visits and information that you submit when using the Website or Product/Service.
(e) If you are Customer, you will be asked to provide business contact information including name, job title, company name, email address, mailing address, and telephone number. Customers who have chosen to pay via credit card, may provide credit card information via a secure form to our credit card processor at paypal.com. VIAT Services does not have access to credit card numbers and they are not saved on our servers.
(d) If you are simply visiting the Website, you may choose, but are not obligated, to register with us and provide contact information such as your name and email address so we can provide you with additional information about our products and services.
(f) information from third parties, and
(g) traffic and usage information generated from your visits to the Website, including the type of device that you use to access it.



(e) If you are located in the EU and are an ASSESSMENT TAKER, your rights are protected under GDPR. If you are asked to input an identifier when taking an assessment, we ask you not to input any personal information. You can ask us to stop storing or processing your data at any time by emailing info@viatservices.com.

5. HOW WE COLLECT INFORMATION.

5.1. Tracking Technologies We Use. We may use one or more of the following technologies to collect Personally Identifiable Information and other information: cookies, flash cookies, general log information, clear gifs, and referral information from third-party websites. We may also use tracking technologies to collect information about your visits over time and across third-party websites or other online services. We may also collect analytics data, or use third-party analytics tools, to help us measure traffic and usage trends for the Website. These tools collect information sent by your browser or mobile device, including the pages you visit, your use of third party applications, and other information that assists us in analyzing and improving the Website.

5.2 Do Not Track. Although we do our best to honor the privacy preferences of our Users, we are not able to respond to Do Not Track signals from your browser at this time.

When you access our Website by or through a mobile device, we may receive or collect and store a unique identification numbers associated with your device or our mobile application (including, for example, a UDID, Unique ID for Advertisers ("IDFA"), Google Ad ID, or Windows Advertising ID), mobile carrier, device type, model and manufacturer, mobile device operating system brand and model, phone number, and, depending on your mobile device settings, your geographical location data, including GPS coordinates (e.g. latitude and/or longitude) or similar information regarding the location of your mobile device.

Information disclosed for such purposes is provided to Customers only in an aggregate or anonymous form that cannot be reasonably identified with any particular individual

7. INFORMATION SHARING AND DISCLOSURE.

7.1. Service Providers Generally. We engage service providers to provide services to us. We may share your Personally Identifiable Information with them, (a) subject to our obligations under this Privacy Policy,
(b) subject to any other appropriate confidentiality and security measures, and
(c) on the condition that they use your Personally Identifiable Information only on our behalf and in accordance with our instructions.

7.2. Payment Service Providers. We share your payment information with payment services providers to
(a) process payments,
(b) prevent, detect, and investigate fraud or other prohibited activities,
(c) facilitate dispute resolution such as chargebacks or refunds, and
(d) for other purposes associated with the acceptance of credit or debit cards.

7.3. Others. We may share your personal information in the instances below:

(c) With your employer, career coach, career counselor, researcher in charge of study if you are using the Website or Product/Services at their request, the information you enter through the Website or Product/Services, including PII, may be shared with them,
(d) With other companies owned by or under common ownership as VIAT Services. These companies will use your personal information in the same way as we can under this policy,
(e) With third-party vendors and other service providers that perform services on our behalf, only as needed to carry out their work for us, which may include survey hosting, billing, payments, service fulfillment, web hosting or providing analytic services. We provide only as much information as is needed to perform the services on our behalf,

(h) We may also aggregate or otherwise strip data of all personally identifying characteristics and may share that aggregated, anonymized data and other Aggregate Data (as defined in the Assessment Taker ToU) with third parties.

8. CONTROLS AND CHOICES.

8.1. Your Controls and Choices. We provide you the ability to exercise certain controls and choices regarding our collection, use, and sharing of your Personally Identifiable Information. You may request changes to your PII by contacting us at info@viatservices.com, Subject: PII Changes, and we will use commercially reasonable efforts to honor your request. In accordance with local law, your controls and choices may include any or all of the following:
(a) you may correct, update, and delete your account information,
(b) you may change your choices for subscriptions and newsletters,
(c) you may choose whether or not to receive offers from us, and
(d) you may choose whether you received targeted advertising from us or our partners.

8.2. California Privacy Rights. If you are a California resident, you may have certain additional rights. California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by us to third parties for the third parties' direct marketing purposes. California Business and Professions Code Section 22581 permits registered users who are minors to request and obtain deletion of certain posted content.

You have the right to access, correct, erase, restrict processing, object to processing, and ask that we transfer the data to another organization. (a) are concerned about the accuracy of any Personally Identifiable Information,

(c) would like any of it removed from our records or otherwise deactivated.

9.3. Right to Decline Requests. We may decline to process requests that are unreasonably repetitive, require disproportionate technical effort, jeopardize the privacy of others, are extremely impractical, or for which access is not required by applicable law or for any legitimate purposes.
